NOTICE OF FINDING OF NO SIGNFICANT IMPACT AND 

NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Graves County Fiscal Court. 

REQUEST FOR RELEASE OF FUNDS 

On or about December 10, 2025 the Graves County Fiscal Court will authorize Graves County Economic Development to submit a request to the HUD for the release of Community Project Funding (CPF) funds under the Consolidated Appropriations Act, 2024 (Public Law 118-42) (the FY2024 Act), and the Further Consolidated Appropriations Act, 2024 (Public Law 118-47) (the Further FY2024 Act) to undertake a project known as Graves County Economic Development for the purpose of helping economic development in the county. This project will extend utilities and construct a road to the 500,000 square foot build ready pad site. This road construction will connect two roads and allow the industrial park tenants and laborers two access points to Highway 45. The estimated total project cost is $1,000,000.00 and all of this amount is HUD funded, assisted or insured. The project is located at 1029 Hickory Rd, Hickory, KY 42051. The project is located at a 50 Acre site adjacent to the Hickory Industrial Park which borders the site on both the north and east property lines. Hickory Road is directly south of the project. 

FINDING OF NO SIGNIFICANT IMPACT 

The Graves County Fiscal Court has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Graves County Fiscal Court, 102 Paris Road, Suite 2, Mayfield, KY 42066 or alternatively at Bacon Farmer Workman Engineering & Testing, 2301 McCracken Boulevard, Paducah, KY 42001 and may be examined or copied weekdays 9 A.M to 4 P.M. 

PUBLIC COMMENTS 

Any individual, group, or agency may submit written comments on the ERR to the Graves County Fiscal Court or Bacon Farmer Workman Engineering & Testing. All comments received by December 9, 2025 will be considered by the Graves County Fiscal Court prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing. 

ENVIRONMENTAL CERTIFICATION 

The Graves County Fiscal Court certifies to HUD that Mr. Jesse Perry in his capacity as Judge/Executive consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows Graves County Economic Development to use Program funds. 

OBJECTIONS TO RELEASE OF FUNDS 

HUD will accept objections to its release of fund and the Graves County Fiscal Court’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Graves County Fiscal Court; (b) the Graves County Fiscal Court has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at LouisvilleRROF@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
